- Ditch Creek Revegetation Grand Teton National Park; Teton County, Wy 52.212-4 Contract Terms And Conditions - Commercial Items (May 2015) 1. The Purpose Of This Bilateral Modification Is To Incorporate The Following Changes Into Purchase Order P15px03854. Changes Made Herein Are Within The Original Intent And Scope Of The Purchase Order. All Other Terms And Conditions Remain Unchanged. A. Modification-0002 Was A Government Requested Modification To Purchase Additional Plants Grown By Watershed Restoration Group, Inc. Extra Plants Had Been Grown By The Contractor To Ensure The Total Contract Quantity Of 3,050 Would Be Delivered (Line 00010; Task 1.A). The Excess Plants Were Available Due To Low Mortality During The Growing Phase. It Was Also Agreed By The Parties That These Additional Plants Would Be Potted, Repotted Into One-Gallon Sized Pots, And Over-Wintered For Delivery In The Fall Of 2017. According To The Contractor (Reference Watershed Restoration Group, Inc.'S Modification-P00004 Proposal On Attached Pages), The Carex Hoodii Plants Were Not All Actually Repotted In One Gallon Pots. Instead, 835 Of The Furnished 1,007 Plants Were Delivered In The Original 10 Cubic Inch Size Pots, Resulting In A Price Reduction Of $2,589.60 From The Modification-0002 Amount Of $4,980.00. These Changes, Applicable To The Modification-0002 Agreement, Were Based On A Separate Mutual Agreement Between Former Co Thayne O'brien And Watershed Restoration Group, Inc.; However, The Changes Were Not Actually Incorporated Into The Purchase Order Via A Modification By Former Co O'brien. The Carex Hoodii And All 1,007 Plants Were Accepted By The Government In The Fall Of 2017 And The Contractor Has Been Paid In The Amount Of $2,390.40 For These Plants. Therefore, By Means Of Modification-P00004, The Previously Agreed To Changes Are Now Incorporated Into This Purchase Order. 2. The Total Cost Of This Purchase Order Is Hereby Reduced By $2,589.60 From $34,339.11 For A New Contract Total Of $31,749.51. 3. By Signing This Supplemental Agreement, The Contractor Hereby Releases The Government From Future Equitable Adjustments Attributable To The Changes Herein.

The Purpose Of This Bilateral Modification Is To Incorporate The Following Changes Into Purchase Order P15px03854. Changes Made Herein Are Within The Original Intent And Scope Of The Purchase Order. All Other Terms And Conditions Remain Unchanged. A. Watershed Restoration Group, Inc. Initially Submitted A Modification Proposal On 08/23/2018 Which Was Later Updated On 08/30/2018 And Finalized On 09/22/2018, Including A Revised List Of Plants To Be Delivered Under Task 3 For 2018. Justification: The Contractor Will Provide 130 Ten Cubic-Inch Plants To Make Up For The Shortage Of 90 Thirty Cubic-Inch Plants (Geum Triflorum). Careful Consideration Was Given To The Size Of The Particular Species, And Their Characteristics, To Ensure The Substitutions Were Adequate And Fair. Because Both Sizes Of Plants Are Planted At The Same Spacing, The 90 Substitutes Will Actually Cover 1.5 Times More Ground Than The 30 Plants They Are Substituting For. The Substitutes Are Also Faster Growing Species, So They Will Provide Cover More Quickly. Plants Propagated From Seed Collected In Grand Teton Park Are Difficult To Grow And Maintain, As A Substantial Percentage Of The Plants Die Despite Having Good Care And Being Kept In Suitable Environmental Conditions. The Requested Modification Updates The Plant Order To Reflect The Actual Plants That Will Be Delivered And The Substitute Plants For The Species, E.G. Geum Triflorum (Prairie Smoke), For Which There Is A Shortage Of 90 Plants Out Of The Total Quantity Of 200 For This Species. Reference Attached Pages. B. This Modification Updates The Contract 'Pricing Table' To Correct A $0.31 Error/Omission And To Reflect The Actual Contract Award Amount. (Note: Changes Incorporated In Modifications 0002 And P00004 Are Not Illustrated In The Pricing Table.) Reference Attached Pages. 2. The Total, Previously Modified, Cost Of This Purchase Order Remains Unchanged At $31,749.51. 3.By Signing This Supplemental Agreement, The Contractor Hereby Releases The Government From Future Equitable Adjustments Attributable To The Changes Herein.
